General Terms and Conditions (GTC) and Conditions of Participation for Brick-and-Mortar Stores

A. General Terms and Conditions for all Services (Orders, Purchases, Courses)

1. Scope

These terms and conditions apply to all contracts (manufacture, repairs, purchase of jewelry, wedding ring courses) concluded with MIMOS eGbR (hereinafter "MIMOS") in the stationary store, unless otherwise agreed in writing.

2. Liability

(1) We are liable for damages - irrespective of their legal basis - only insofar as we, our legal representatives, or vicarious agents have acted with intent or gross negligence.

(2) This limitation of liability does not apply to damages resulting from injury to life, body, or health. It also does not apply to the breach of essential contractual obligations (cardinal obligations). Essential contractual obligations are those whose fulfillment is essential for the proper execution of the contract and on whose observance the customer may regularly rely (e.g., careful storage and professional processing of the handed-over items, as well as expert instruction in courses).

(3) In the event of a breach of essential contractual obligations, we are also liable for simple negligence. In this case, however, our liability is limited to the compensation of foreseeable, typical contractual damages. Liability for the intangible value of the items handed over to us is excluded.

(4) We are liable for damages or losses due to burglary, theft, or robbery during storage within the framework of paragraphs 1 to 3. We are not liable for damages due to force majeure.

(5) The items handed over to us for repair, remodeling, or manufacture will be stored for the duration of the processing and a reasonable collection period. If the item is not collected within 4 weeks after notification of completion, we will request the customer to collect it again. After a further 4 weeks without collection, we are entitled to charge storage fees or, after renewed threat, to dispose of the item in accordance with the statutory provisions.

3. Payment, Right of Retention, Retention of Title

(1) The remuneration is due upon acceptance of the work or upon handover of the repaired or manufactured piece of jewelry and must be paid without deduction. For courses, the special payment conditions under Part C apply.

(2) Until full payment of the remuneration and all ancillary claims (e.g., material costs), we are entitled to a right of retention according to § 273 BGB as well as the statutory contractor's lien according to § 647 BGB for the items handed over by the customer and those manufactured or processed by us.

(3) The finished piece of jewelry will only be handed over concurrently with full payment.

(4) Jewelry manufactured by us and sold to the customer remains our property until full payment (retention of title according to § 449 BGB).

4. Data Protection

The collection and processing of personal data takes place exclusively for contract processing and customer support in accordance with Art. 6 Para. 1 lit. b GDPR. Disclosure to third parties only takes place insofar as this is strictly necessary for the fulfillment of the contract. 5. Final Provisions

Should individual provisions of these GTC be ineffective, the remainder of the contract remains effective. In place of the ineffective provision, the statutory provisions apply.

Consumer dispute resolution: We are not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board.


B. Special Conditions for Manufacturing, Repairs, and Old Gold

1. Condition and Deviations

(1) Jewelry from our workshop is individually handcrafted. For custom-made products or alterations according to customer specifications (e.g., sketches), minor deviations in material, shape, color, or execution may occur due to craftsmanship or material properties.

(2) Such minor deviations do not constitute a defect, provided they do not significantly impair the agreed quality, functionality, or overall aesthetic impression of the jewelry. We strive to remedy such deviations within the scope of technical possibilities.

(3) For contracts for work (custom-made products), there is no right of withdrawal and no right of return due to dislike, provided the work has been created without defects.

2. Delivery of Old Gold

(1) An examination and, if necessary, dismantling (e.g., removal of stones) may be required to evaluate the old gold delivered. The customer agrees to this necessary examination (and, if applicable, destruction of the shape of the old gold).

(2) We do not guarantee a specific alloy composition or exact fineness beyond the result of the professional examination.

(3) If old gold is melted down and reprocessed, material defects (e.g., pores, cracks) or color deviations may occur despite the greatest care, which are inherent in the old material. This does not constitute a defect in our craftsmanship.

3. Ring Size Adjustment (Service)

(1) If a ring does not fit, we offer the following goodwill adjustments, provided no material addition is necessary:

  • Purchase from showcase/assortment (bought to fit): Free within 3 months if it no longer fits.
  • Gifts/Engagement rings (bought without trying on): Free within 6 months.
  • Rings made in a course (made to fit): Free within 3 months.

(2) If material has to be added or the change is made after the deadlines, we will charge for the adjustment based on effort and material costs.


C. Special Conditions for Wedding Ring Courses

1. Registration and Cancellation

(1) Registration for the course is binding. Since we reserve the workshop and staff for you, cancellations incur costs for us.

(2) In the event of cancellation by the participant, the following flat processing fees apply:

  • Up to 6 weeks before the start of the course: €100.00 per couple.
  • Up to 4 weeks before the start of the course: €150.00 per couple.
  • Up to 2 weeks before the start of the course: €200.00 per couple.
  • Less than 2 weeks before the start of the course: €350.00 per couple.

(3) Important note: The participant is expressly permitted to prove that MIMOS has incurred no damage at all or that the actual damage incurred is significantly lower than the flat rate mentioned above.

(4) In case of short-term illness, we try to find an alternative date. If this is not possible, we will make the rings for the participants.

2. Manufacturing by Laypersons

Participants make the rings themselves under guidance. MIMOS accepts no liability for optical irregularities resulting from the participants' lack of craftsmanship, provided that the course instructor has fulfilled their duty of instruction.


D. Special Conditions for the Purchase of Merchandise (Showcase Items)

1. Voluntary Right of Return

(1) For unworn and undamaged jewelry from our stock (no custom-made items), we voluntarily grant a 14-day right of return against reimbursement of the purchase price or exchange.

(2) There is no statutory right of withdrawal for purchases in the retail store.
